Acceptance of Terms

By accessing or using the Services provided by the SeenWithLove Foundation ("Foundation," "we," "our," or "us"), including but not limited to the seenwithlove.com website, AlexListens.com, MyCareEcho.com, MyDailyHug.com, and any related programs or communications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to all the terms and conditions of this agreement, then you may not access the Services. These Terms apply to all visitors, users, and others who access or use the Services.

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the effective date at the top of this page. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.

Description of Services

The SeenWithLove Foundation operates several programs and digital properties designed to restore emotional visibility and dignity to overlooked and underserved populations:

• AlexListens — An AI-powered emotional companion platform providing 24/7 conversational support to seniors, LGBTQ+ individuals, veterans, caregivers, and others who may lack access to traditional support. AlexListens is not a licensed mental health service and does not provide clinical therapy, diagnosis, or medical advice.
• CareEcho — A daily emotional check-in program designed for caregivers in assisted living facilities and similar care settings. CareEcho is an organizational wellbeing tool and is not a substitute for professional mental health services.
• The Daily Hug — A free daily email message program delivering soul-centered, uplifting messages to subscribers. The Daily Hug is a communications program and does not constitute therapeutic or clinical services of any kind.
• The SeenWithLove Website — Our primary informational website providing information about the Foundation, our programs, and opportunities to get involved or donate.

Important: Our Services are designed for emotional support and community connection. They are not substitutes for professional mental health treatment, clinical therapy, crisis intervention, or emergency services. If you or someone you know is in crisis or danger, please contact emergency services (911 in the United States) or a mental health crisis line immediately.

User Conduct

You agree that you will use our Services only for lawful purposes and in a manner consistent with the caring, dignity-centered mission of the SeenWithLove Foundation. You agree not to:

• Use the Services in any manner that violates any applicable local, national, or international law or regulation
• Use the Services to transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material
• Use the Services to transmit any material that is defamatory, offensive, harassing, abusive, threatening, or otherwise objectionable
• Impersonate or attempt to impersonate the Foundation, a Foundation employee, another user, or any other person
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
• Attempt to gain unauthorized access to any portion of the Services or any systems connected to the Services
• Use any robot, spider, or other automatic device to access the Services for any unauthorized purpose
• Attempt to decompile, reverse engineer, or disassemble any software or technology that powers our Services

Intellectual Property

The Services and their original content, features, and functionality are and will remain the exclusive property of the SeenWithLove Foundation and its licensors. Our trademarks, service marks, and logos may not be used in connection with any product or service without the prior written consent of the Foundation.

This includes but is not limited to: the SeenWithLove Foundation name and logo, the AlexListens name and brand, the CareEcho name and brand, The Daily Hug name and brand, World Love Week™, JoyDrops™, the Soul Council name and brand, and all related marks, trade dress, and creative work.

Content published by the Foundation — including Daily Hug messages, website copy, program materials, and educational resources — may be shared for non-commercial purposes with proper attribution to the SeenWithLove Foundation. Commercial use of any Foundation content requires prior written permission.

Donations

The SeenWithLove Foundation is a 501(c)(3) nonprofit corporation. Donations made to the Foundation may be tax-deductible to the extent permitted by applicable law. The Foundation makes no guarantee as to the deductibility of any specific donation, and donors are encouraged to consult a tax professional regarding their specific situation.

All donations are final and non-refundable except in cases of demonstrable error in processing. If you believe a donation was processed in error, please contact us at hello@seenwithlove.org within 30 days of the transaction.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

The Foundation does not warrant that the Services will be uninterrupted, timely, secure, or error-free; that the results that may be obtained from use of the Services will be accurate or reliable; or that the quality of any Services obtained will meet your expectations.

The Foundation's AI programs, including AlexListens, are not licensed mental health professionals and do not provide clinical diagnoses, treatment recommendations, or medical advice. The Foundation is not responsible for any decisions made based on communications through our AI programs.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SEENWITHLOVE FOUNDATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, our liability shall be limited to the maximum extent permitted by law.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the applicable state laws, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation and, if necessary, binding arbitration.
